Terms & Conditions
1. BOOKING PROCEDURE
The following booking conditions will form the contract for your tour with us.
In this contract a reference to "You" and "Your" includes the lead-named person on the confirmation email and all persons on whose behalf a booking is made.
“We” or “Us” are Bike Bellarine of Ocean Grove VIC 3226, Australia.
“Meeting Point” means the place specified by us as the place we will meet for your transfer or your arrival at the tour start location.
“Start Date” means the date on which you board our transfer service or arrive at the tour Meeting Point.
“Tour” means a tour organised by Bike Bellarine.
If you make a booking on behalf of others as well as yourself, we shall take it that you have the authority of each of those other people to enter into that contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people with these contract terms.
If we are unable to accept your booking, we will of course return any payment made back to you immediately.
To make a booking, we require full payment prior via our online booking gateway.
Upon receipt of payment, a booking confirmation will be sent to you by email.
We have the right to not accept your booking for any reason and we do not have to give you that reason.
2. TOUR INCLUSIONS AND NON INCLUSIONS
• Bike hire, helmet and water bottle;
• Lunch and beverages at a nominated venue to the value as stated on your voucher;
• Overnight queen/twin share accommodation;
• Breakfast as stated at your accommodation;
• Return transfers to Drysdale from Portarlington (transfers to and from Queenscliff ferry terminals may incur an additional fee);
• Transfer of your luggage to and from your accommodation;
• Ride map and ride information;
• Entry fees to other tours and attractions as stated on the tour;
• Any other travel or accommodation costs incurred to arrive at the nominated meeting point;
• Travel insurance or any other personal insurance policies taken out by yourself;
• Any necessary medical treatment and medical transportation expenses incurred by yourself before, during and after the tour;
• Evening dinner and/or other food and drink that is not stated under inclusions;
• Any other personal purchases or expenses that are not stated under inclusions;
• Gratuities you choose to give, in addition to any we give on your behalf where we consider appropriate.
3. PAYMENT PRODCEDURE
3.1 Full payment of your tour is due to us no later than 72 hours before the tour start time via our online booking system.
3.2 Any tour payment made less than 7 days prior to the commencement of your tour will be marked as pending and will be only be honored subject to accommodation and bike availability.
3.3 In the event that we cannot guarantee availability for either we will offer a full refund or offer an alternative date.
4. REFUND AND CANCELLATION POLICY
4.1 If you need cancel your booking for any reason, we will refund your payment in full if written notice is given to us by email to firstname.lastname@example.org no less than 14 days before the tour start date.
4.2 All cancellations must be given in writing by email to email@example.com;
4.3 Any cancellations made inside 14 days from the tour start date (i.e. 13 days or less) will incur the following cancellation fee;
- 13 days to 7 days prior to tour start date - 50% of total payment
- Less than 7 days prior to tour start date – 100% of total payment
4.4 No refund or compensation will be given for no-shows, arriving late or leaving trips early.
4.5 Refunds will not be given on flights, external accommodation, external tours or non included travel connections booked as a part of the tour.
4.6 In any circumstances giving rise to cancellation, we will consider allowing you to transfer the money you have paid to another tour you choose. This will be subject to the cancellation notice you have given us and any associated cancellation fee that is applicable. Whether we do so is in our discretion and is subject to availability.
5. CHANGES TO TOURS
5.1 Bike Bellarine endeavors to run and operate all tours as outlined. However, the nature of our tours requires participants to allow for and respect any necessary changes or alternatives made due to circumstances that are out of the control of Bike Bellarine.
5.2 Where changes to any tour are required to be made due to force majeure* no compensation will be made and any cancellation made by you will be subject to any cancellation fee.
5.3 In the circumstance that a tour must be cancelled prior to commencement due to force majeure*, a full refund will be paid less reasonable expenses incurred by Bike Bellarine.
5.4 If a tour is cancelled after commencement due to force majeure*, no refund will be paid except for expenses or costs that have not yet been paid to any third parties and which Bike Bellarine is not required to pay, or has been refunded by any third party.
*Force majeure refers to any unusual or unforeseeable event beyond the control of Bike Bellarine’s control, the consequences of which Bike Bellarine could not avoid. This includes but is not limited to; war or threat of war, riots, political or civil strife or unrest, terrorist activity, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, floods, health risk or epidemic, Acts of God, or other similar events.
6. BIKE HIRE TERMS AND CONDITIONS
6.1 All participants will be required to sign a bike hire agreement from our bike hire contractor prior to starting the tour;
6.2 It is compulsory for all participants to wear a provided helmet at all times whilst riding as per the law in the state of Victoria;
6.3 Closed toe footwear must be worn whilst riding;
6.4 All bike riders must be 18 years or over (contact us for options for under 18 riders)
7. LIABILITY FOR PERSONAL INJURY, LOSS OR PROPERTY DAMAGE
Bike Bellarine shall have no legal liability whatsoever;
(a) For any loss or damage to your property, luggage or other personal effects, and such items shall remain at your risk at all times, including when being carried by or under the control of a Bike Bellarine employee, supplier or contractor;
(b) For any inconvenience, delay, illness, personal injury, or death, or any other loss or damage you may suffer arising directly or indirectly from any aspect of the tour;
(c) For any injury, damage, death, loss, accident or delay to you or your property due to an act and/or omission of any supplier or service provider to Bike Bellarine or by an Act of God;
(d) For any loss, damage or delay due to an event of force majeure, sickness or injury to a participant on the tour, theft, or any other causes beyond the control of Bike Bellarine.
7.1 You agree, for yourself and your heirs, executors, administrators and assigns to release Bike Bellarine, its employees, agents, officers, representatives from any and all claims for loss, damage or injury suffered by you as a direct or indirect result of your participation in the tour and, to the fullest extent permitted by law, you expressly waive any claims you may have against Bike Bellarine arising out of or in connection with your participation in the tour.
7.2 You acknowledge that cycling is a physical activity and that there are potential hazards and a degree of risk associated with participating in the tour. You assume responsibility and liability for all associated risks of the tour.
7.3 To the fullest extent permitted any condition or warranty which would otherwise be implied by law into these terms and conditions is excluded.
7.4 To the fullest extent permitted by law, any claim by you for indirect or consequential loss, loss of profits, economic loss, or for special, punitive or exemplary damages is excluded.
8. LIMITATIONS OF OUR LIABILITY
8.1 We want you to enjoy a great tour with Bike Bellarine. Nonetheless, we must make clear the limitations in law. We are not liable to you for;
8.2 Any event which happens before you arrive at the Meeting point or at departure from the Meeting point;
8.3 Any problem arising from your failure to reach the tour destination or Meeting Point on time, for whatever reason; (though we would do our best to help you in any way we reasonably could);
8.4 Any aspect of goods or services you buy or accept other than those arranged by us;
8.5 Medical problems or physical difficulties, even if you have told us about them in advance;
8.6 Medical emergencies;
8.7 Your own carelessness or negligence in any aspect of your behavior whilst on our Tour;
8.8 Changes we reasonably make to an itinerary or to accommodation or any other aspect of the management of a Tour;
8.9 Problems or issues which we could resolve whilst on a Tour but which you raise only after your return.
9. PARTICIPATION AND BEHAVIOUR
9.1 If we need to provide medical help to you, whether or not you specifically ask for it, we will provide receipts or invoices for all costs (for your insurer). You agree to repay to us any costs that may be incurred by us from the Tour.
9.2 If at any time, it is our opinion that you are acting in a way which may cause accident, injury, discomfort or extreme displeasure to any other tour participant, we may exclude you from the tour. You will understand that this extreme action will not be taken lightly but may be necessary to protect the health, safety or enjoyment of other clients.
10.1 We try our utmost to provide a happy and tour for all participants, but if we fail in any way, do please raise any issue with us immediately.
10.2 If your complaint cannot be satisfied or it is not dealt with to your satisfaction at the time of reporting, then you should give us full details in writing, immediately on your return.
11. PROMOTIONAL MATERIAL
You agree that any images or video footage taken on the tour by Bike Bellarine representatives or contractors may be used in promotional material including brochures, advertising, websites or as editorial content without your consent or providing you without any payment in respect of such use. The grant of such a licence is irrevocable and operates worldwide.
12. LAW AND JURISDICTION
The validity, construction and performance of this agreement shall be governed by the laws of the State of Victoria, Australia. Any dispute arising in connection with this agreement shall be subject to the exclusive jurisdiction of the Victorian courts.
